Guide Prices
Should Be Scrapped
The government-appointed group set up to investigate the practices of auctioneers
and estate agents will recommend that guide prices be scrapped and that an independent
body be set up to police the sector.
The group, which had its final meeting last Monday, is expected to recommend
that frequently misleading guide prices be replaced by a new figure, to be known
as the gadvised minimum value'e.
But, sources familiar with the work of the group, established almost a year ago
by the Minister for Justice, Michael McDowell, were divided on the effectiveness
of the replacement for guide prices.
It is understood that another recommendation is that auctioneers would no longer
have to go to the District Court once a year to renew their licence but that
this process would be handled by a new authority.
The body would also be responsible for standards, training and dealing with complaints
from the public, with powers to censure, fine or remove a licence if necessary.
The group's chairman, Alan McCarthy, told other members that his aim was to introduce
protection for the consumer, but to have the minimum level of regulation to allow
the market to operate.
One of the main tasks of the group was to investigate the practice of quoting
a guide price which is outstripped, sometimes by millions of euro, by the subsequent
sale price of a house at auction.
Under the gadvised minimum value'e proposal, auctioneers would have to give their
gtrue opinion'e of the value of a property to the seller in writing at the beginning
of the marketing campaign.
This would be the only figure to be used throughout the sale period.
One source said that only 10 per cent of houses were auctioned and that most
auctions took place in Dublin where about six large auctioneers handled the majority
of the business.
gUndoubtedly some firms do put the guide price low as a ecome on', but obviously
it is also a feature of a booming economy that prices go way above what people
expect,h said the source.
Another cause of concern for consumers centred on gghost bidding'e.
It is understood the group will propose that an auctioneer must retain a file
containing details of parties who make offers on a property and exactly how much
was offered.
At the time of the establishment of the group, the Director of Consumer Affairs,
Carmel Foley, criticised the ghuge fees'e being charged by auctioneers, saying
they did not reflect the level of service being provided to clients.
Fees are based on a percentage of the sale price and the recent huge inflation
in house prices has resulted in massive profits for estate agents.
The group is understood to have recommended that an auctioneer give a seller
an indication of the likely gabsolute amount'e to be charged based on the gadvised
minimum value'e, the cost of advertising, Vat and any other expenses, at the
beginning of the sale campaign.
The group's report is being finalised and is expected to be delivered to the
minister over the next few weeks.
It is believed that it will also recommend that the new regulatory authority
should review the issue of the ?12,700 bond which auctioneers have to lodge with
the District Court when applying for their licence.
The two representative bodies for auctioneers - the Institute of Professional
Auctioneers & Valuers (IPAV) and the Irish Auctioneers & Valuers Institute
(IAVI) - both have additional compensation funds.
But auctioneers who are not members of either body could have significant amounts
of clients' money in their bank accounts but with a relatively low bond lodged.
The group included representatives of the two auctioneering bodies, as well as
the Consumers' Association of Ireland, the Irish Farmers Association and a number
of civil servants.

News Unveils Online Auction
Emapfs Motorcycle News magazine has joined the burgeoning world of online auction
houses and launched its own buying and selling shop.
MCN Auctions,
which is contained within the magazinefs existing website,
allows users to buy and sell motorbikes, spare parts, tools,
memorabilia and kit.
The first item to be sold on the site was a motorcycle that once belonged to
World Superbike champion Carl Fogarty.
The auction house has been established to compliment MCNfs classified advertising
sales offering and has been billed as a new gdimensionh to the magazinefs commercial
activity.
Publisher Charley Davies said: gWhilst advertising in our weekly newspaper,
Motor Cycle News, is still the most popular way to sell your bike, a growing
number of our readers wanted further choices.
gWe re-launched our website motorcyclenews.com last year, adding online classified
booking facilities.
gThis strengthened our position as the UK motorcyclistfs favourite choice for
selling his or her bike.h
The site will operate in the same way as existing online auction houses, such
as global success story Ebay.
Jayan Taank, private classified advertising manager, said: gThe site is initially
just for private advertisers, and every listing on the website will be checked
before going live.
