Tsunami Scam

A new fraudulent email has begun circling the Internet. It claims to be from an Asian charity helping the victims of the recent devastating Tsunami that hit South-East Asia.
A member of an anti-scam forum has said, Nigerian scammers have sent out an email, originating from Lagos in Nigeria, claiming to be from a Singaporean charity that is involved with the relief effort. They ask that recipients send money by Western Union to help out the victims of the disaster.
The fraudulent email states:

“DEAR SIR/MADAM

SIR WE WANT TO SAKE YOUR HELP AND SUPPORT FINANCIALY FOR THE ASSISTANCE OF THE DISSASTER FOR THE DISPLACED PEOPLE IN THE ASIA TSUNAMIS EARTHQUAKE ATTACK. WE ARE SOLID FOUNDATION A HUMANITARY AND NON GOVERNMENTAL ORGANISATION IN ASIA.

PLEASE WE NEED YOUR SUPPORT WITH AT LIST £100 UPWARD TO ASSIT MORE THAN 2,000,000 DISPLACED PEOPLE AND OVER 500,000 HOMELESS, AND over 33,000 poeple are dead and we need to assit the families of the dead people. WE NEEDED THE FUNDS TO HELP GET FOOD, MATERIALS, DRUGS, FUEL, ETC...

It’s Peter Parfait here, with an article written by property lawyer Graham Hughes regarding the legal due diligence one should perform when buying property abroad. I trust that you may find this advice useful in your property dealings:

10 Top Tips For Buying Property Overseas
More and more Britons are looking to buy property abroad, as holiday homes, financial investments or for permanent relocation. Here UK solicitor Graham Hughes of Cheshire-based Grace & Co, who has specialised in overseas property conveyancing for over 16 years, and is also an official public notary, offers 10 useful tips for potential buyers, who don’t wish to throw away their hard-earned money by disregarding basic rules.

1. Get Legal Advice Before You Start
Whether you’re going on an inspection flight or viewing independently through local estate agents, when considering the purchase of overseas property you’ll be in a pressurised environment, with enthusiastic and not-so-scrupulous representatives encouraging you to sign. They’re mostly on commission after all. So it pays to get some pointers about the potential legal pitfalls. UK solicitors with overseas property experts, like myself, will usually give you free, initial advice, including an indication of costs, in a face-to-face meeting or over the phone. In this country you might not bother because you’ve probably already bought a home before, but in Europe, America, Australia, South Africa and the rest of the world the property market is different and the legalities complex, so you need to be pre-armed.

2. Don’t Rely On The Vendor’s Solicitor
If you allow the solicitor acting for the vendor, estate agent or property developer to act for you too, then you are asking for trouble. Don’t let someone in a bar convince you ‘that’s the way they do things here’ (surprisingly the legal systems in Spain, Italy, Portugal and elsewhere do allow solicitors to act for both sides), because it’s certainly not normal procedure, due to obvious conflict of interest. Consider, if your shared solicitor discovers something detrimental to the sale, is he or she going to reveal all to you, a one-off client, or protect his long-standing commercial interests? If you find out later there was a problem, you’re going to have to seek redress against that solicitor in a foreign court, which will be difficult and costly. I’m not saying foreign solicitors are unprincipled, but don’t needlessly risk a possible conflict of interest ruining your dreams.

3. Choose Your Own Independent Solicitor
In this country solicitors cannot act for both sides in a property transaction, other than in exceptional circumstances, purely because of potential conflict of interest. So the answer is pick your own. Which raises the difficulty, especially in a foreign country, of where you find a good one? The yellow pages, a ‘recommendation’ from your estate agent or simply knocking on doors can raise additional worries (especially the latter). One increasingly popular solution is to use a UK-based solicitor who is skilled in overseas property conveyancing. He or she should have experience of handling property transactions where you’re buying and legal associates in that country who can undertake the local searches. The solicitor doesn’t even need to be near your UK home, since most of the communications will be legal correspondence. And don’t believe overseas agents and developers who say a home-based solicitor will increase your costs and delay procedures. In my experience, that’s most certainly not true.

4. Make Sure You Can Talk To Your Lawyer
Even in this country, people seem to find it quite daunting to talk to solicitors (I can’t imagine why!), so how much more difficult and disheartening is it trying to communicate in a foreign language? Your school French, Spanish or Italian may be fine for ordering a meal, but understanding the nuances of legalese is quite another matter. Key points lost in translation can become problematic when they’re written into a contract. Buying in English-speaking countries like America and Australia can still lead to misunderstandings (separated by a common language, they say), with terms like ‘completion’ and ‘closing’ causing confusion. But the main problem is the time difference, which means you have to call your solicitor at extremely inconvenient times (as a solicitor to the High Court in Hong Kong, I often make calls at 3 am!). So, without labouring the point, you can talk conveniently to a British solicitor – and we’re not that frightening.

5. Has Your Solicitor Professional Indemnity?
When buying property in this country, you’re covered because your solicitor must have professional indemnity insurance, which guarantees you compensation should you incur any losses due to their negligence. The Law Society demands this and you cannot obtain a practising certificate without this, quite expensive, cover. Surprisingly, in some countries this is not always a requirement of practice, so you will need to verify whether your overseas lawyer maintains indemnity insurance. If he or she doesn’t and you lose substantial money through professional negligence, you will find yourself having to sue a foreign lawyer under his or her native jurisdiction, which at the very least is going to be a costly and long drawn-out process. Here you don’t need to sue your solicitor, you just make a claim and are compensated in British sterling – and exactly the same applies to foreign property conveyancing.

6. Is Your Money In A Separate Account?
In this country lawyers are obliged to hold their clients’ money in a separate bank account, which is guaranteed by strict Law Society regulations. Even if your money goes astray through professional malpractice, you will be compensated from a separate fund, to which all solicitors must contribute. So your money is safe (aren’t we wonderful!). However, this is not always the case in other countries. So if your solicitor is sued or made bankrupt, for reasons totally unconnected to you, the courts may seize his or her total assets for dispersing to creditors, including your precious deposit, completion monies or stage payments. Since the concept of trusts is often unknown in other countries, even if your money is held in a separate account, it may not be protected and if your lawyer dies, it can become part of his or her estate against which you would be forced to make a claim.

7. Does The Vendor Own The Property?
Don’t assume the vendor actually owns the property. You will need to ensure the deed of title is properly investigated, which is the job of your solicitor. Certainly cases regularly arise where the person selling doesn’t have good title, either for fraudulent or innocent reasons. Inheritance laws in certain European countries mean that ownership is divided between siblings, often of different generations, and these rights cannot be overridden by a will; it may even be that a wife’s children from a previous marriage have prior claim to the title. It is also not unheard of for someone to take a short-term lease on a property, then sell it using falsified documents, only for the legitimate owner to turn up later and eject the ‘buyers’. It’s even been known for estate agents to deliberately misrepresent properties as their own. Unfortunately, it can be a dog-eat-dog world out there, so don’t believe everything you’re told; check it out.

8. Are There Charges On The Property?
You and your appointed solicitor will need to ascertain that the property is free from charges and encumbrances, such as outstanding mortgages, pre-emptions (rights of purchase), tax or other liens (legal rights to another’s property), or that these will be discharged on completion. National and regional authorities in Europe can attach charges to properties for unpaid taxes, sometimes without the owner even knowing, so these will need to be checked before completion. It’s also not unknown for a vendor to agree to a sale, then negotiate a substantial bank loan and leave the new owner with the charge. Remember too that notaries, who in certain European countries ensure the proper legalities are upheld, are not obliged to tell you what mortgages or other encumbrances are registered against the property, they merely attend to the legal formalities.

9. Does The Builder Have A Licence?
Builders are often required to have an official licence to operate as a developer, not to mention a licence to build that particular property in that particular place. If you’re having a house built, you will need to see that licence, then verify that the builder is complying with the legalities regarding construction and that the property is being built in accordance with the planning permission. If buying off-plan, in particular, you will need to ascertain whether the builder has the necessary bank guarantees in place, before construction has actually started, so that if the building work is not completed for whatever reason or the project runs into financial difficulties, you can get your money back. Really, here I’m referring to smaller firms and potential fly-by-nights, since major developers presumably have their corporate reputations to protect, but don’t be afraid to ask the questions anyway.

10. Is There Proper Planning Permission?
If you’re purchasing a plot and having a house built, or buying a property under construction, off-plan, you will need to be reassured the builder has attended to all the necessary planning requirements and there is nothing illegal about the development. Land is often designated for possible construction or agricultural use and you will need to determine whether proper permission has been obtained and that the plans comply with restrictions regarding height, floor space and distance from boundaries. Certificates for the connection of water, electricity and services must also be obtained. Even with existing properties, it’s necessary to determine whether swimming pools and extensions have the necessary permission, otherwise you might be forced to remove them at your expense. It’s also worrying to note that the new Spanish government has vowed to demolish illegally-built homes, which are sited within 300 ft of the shoreline.

Admittedly, I’ve sketched out some nightmare scenarios and, in fairness, most foreign lawyers, developers and estate agents are thoroughly decent, honest and professional people who will endeavour to ensure your property purchase goes smoothly. But don’t take this for granted. There’s a lot of money at stake – and it’s yours! Unfortunately, I’ve known many people who have lost their life savings and even put their UK home at risk, because they didn’t seek proper, independent legal advice from the outset. I’m also often involved in the tail end of cases where properties have been seized and dream homes demolished, due to disasters over deeds, ownership, charges and planning.

Obviously, I recommend consulting a British lawyer, who has an in-depth understanding of foreign property conveyancing and a network of local legal associates, who can carry out searches, visit planning offices and register titles in the country in question. But whatever you do, please follow my simple ABC guide to property purchase: seek proper Legal Advice, stick to your carefully constructed Budget and always adopt an attitude of Caution!

those times first.
